These Terms & Conditions ("Terms") govern your access to and use of NexWall, including the mobile app, related APIs, and public support/legal pages.
1. Eligibility
- You must use NexWall in compliance with applicable laws and platform policies.
- You are responsible for your account activity and for keeping account credentials secure.
- If local law requires parental consent for minors, such consent must be obtained before use.
2. License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use NexWall for personal, non-commercial use.
3. Content Usage Rules
- Static, video and live wallpapers are provided for personal device customization unless stated otherwise.
- You must respect copyrights, trademarks, and other intellectual property rights.
- You must not claim ownership of content you did not create or license.
- You must not remove attribution, watermark, or rights notices where they exist.
- You must obtain rights holder permission for commercial use, redistribution, or resale.
4. Prohibited Activities
- Reverse engineering, unauthorized scraping, bulk extraction, or API abuse.
- Attempting unauthorized access to systems, accounts, endpoints, or admin interfaces.
- Introducing malware, scripts, bots, or activity that degrades service reliability.
- Using NexWall in any way that violates law, third-party rights, or app store rules.
5. Copyright and DMCA Policy
NexWall respects the intellectual property rights of others. Static, video and live wallpapers provided in the app are sourced from public domain databases, licensed from creators, or are user-submitted under the premise that they are free to use.
If you are a copyright owner and believe that any content on NexWall infringes upon your copyrights, please submit a DMCA takedown notice to support@kodnextech.com with the following details:
- A description of the copyrighted work that you claim has been infringed.
- A screenshot or exact link to the infringing material within our app.
- Your contact information (name, address, telephone number, and email).
- A statement that you have a good faith belief that the use of the material is not authorized.
Upon receipt of a valid notice, we will promptly remove the infringing content.
6. Advertisements
NexWall displays third-party ads through Google AdMob. We do not control advertiser products or claims. Your interactions with advertisers are strictly between you and those third parties.
7. Intellectual Property
NexWall branding, source code, interface components, and service assets are owned by or licensed to KodNex. All rights not expressly granted remain reserved by the lawful owners.
8. Service Availability and Updates
- We may add, change, pause, or remove features for maintenance, security, or product updates.
- We may require minimum app versions for compatibility and safety.
- Service interruptions may occur due to network, provider, or infrastructure events.
9. Disclaimer of Warranties
NexWall is provided on an "as is" and "as available" basis, without warranties of any kind, to the extent permitted by law.
10. Limitation of Liability
To the maximum extent permitted by law, NexWall and its operators are not liable for indirect, incidental, special, or consequential damages arising from use of, or inability to use, the service.
11. Indemnification
You agree to defend and indemnify NexWall and its team from claims, losses, or expenses caused by your misuse of the service or violation of these Terms.
12. Termination
We may suspend or terminate access where necessary for policy enforcement, legal compliance, abuse prevention, or security protection.
13. Account and Security Responsibilities
- You are responsible for maintaining confidentiality of your login credentials.
- Any activity performed through your account is considered authorized by you unless reported as unauthorized access.
- You must notify us quickly if you suspect account compromise or unauthorized activity.
14. Governing Law
These Terms are governed by applicable law. Where mandatory local consumer laws apply, those laws take precedence over conflicting clauses.
15. Privacy and Data
Your use of NexWall is also subject to our Privacy Policy, which explains data collection, usage, retention, and your rights.
16. Changes to Terms
We may revise these Terms. Continued use after updates means you accept the revised Terms.
